IT IS UNDEVELOPED, SO THERE IS NOTHING ON THE PROPERTY RIGHT NOW.

IT IS APPROXIMATELY 0.4 ACRES AND IT IS ALSO KNOWN AS AVIATION HEIGHTS LOT 61 BLOCK 24.

UM, AND WE WILL BE POSTING A PUBLIC HEARING NOTICE IN THE SAN ANTONIO EXPRESS PRIOR TO THE CITY COUNCIL HEARING, AND THE APPLICANT PLACED A SIGN OUTSIDE OF THE SUBJECT PROPERTY.

SO AGAIN, JUST GIVING SOME BACKGROUND, THE APPLICANT IS PROPOSING TO GO FROM R TWO TO R SIX ON THE 0.4 ACRE PROPERTY.

AND AS SOME OF YOU MIGHT KNOW, AVIATION HEIGHTS IS ONE OF THE OLDEST SUBDIVISIONS WE HAVE HERE IN SHORT.

SO THIS IS AN IMAGE OF THE ORIGINAL PLAT OF THAT SUBDIVISION.

AND THE PROPERTY WE'RE DISCUSSING TODAY IS OUTLINED IN RED.

SO YOU CAN KIND OF SEE HOW A LOT OF THESE LOTS WERE SIGNIFICANTLY SMALLER.

BUT YOU'LL SEE HERE, UM, DIRECTLY FROM THAT REPLANT DONE FROM THAT PROPERTY IN 2019, THEY COMBINED LOTS, 44, 45, 46, 47, AND 48, AND A PORTION OF 43 TO MAKE LOT 61 WHAT IT IS TODAY.

BUT THAT ONLY O GOES FURTHER TO SHOW YOU THAT THE PARCEL ADJACENT TO IT THAT HAS A SINGLE FAMILY HOME IS ACTUALLY MADE UP OF TWO LOTS PLUS THE OTHER HALF OF 43.

SO IT'S A VERY UNIQUE SUBDIVISION.

UM, AND IT'S ESSENTIALLY A LOT OF THESE LOTS ARE MADE UP OF MULTIPLE LOTS WITHIN THAT ORIGINAL SUBDIVISION.

SO AGAIN, THE APPLICANT, UH, CURRENTLY HAS SINGLE FAMILY RESIDENTIAL DISTRICT R TWO ZONING, WHICH, UH, REQUIRES 70 BY ONE 20, UM, MINIMUM LOT WITHIN DEPTH, AND THEY'RE REQUESTING R SIX 60 BY ONE 20.

UM, PER THE LETTER OF INTENT, THE APPLICANT HAS ENOUGH SPACE ESSENTIALLY TO SPLIT THE LOT IN HALF AND PILL TWO SINGLE FAMILY HOMES AND THEY'RE TRYING TO BUILD A HOME FOR THEMSELVES AND ESSENTIALLY, UH, FOR THEIR PARENTS.

SO THAT'S THE REASON FOR THIS REZONE TODAY.

AND AGAIN, WHEN WE LOOK AT ZONE CHANGES, WE LOOK AT UDC, SECTION 2154 D FOR TOWARDS THE CRITERIA FOR APPROVAL AND WHETHER THIS PROPOSED ZONE CHANGE IMPLEMENTS THE POLICIES OF THE ADOPTED COMPREHENSIVE LAND PLAN OR ANY OTHER APPLICABLE ADOPTED PLANS.

SO THIS WHOLE AREA WITHIN THE AVIATION SUBDIVISION IS DESIGNATED AS COMPLETE NEIGHBORHOOD.

AND AGAIN, IT'S SUPPOSED TO BE A MIX OF RESIDENTIAL SUPPORTING LAND USES, NEIGHBORHOOD COMMERCIAL, KIND OF, YOU KNOW, BUILDING THAT NEIGHBORHOOD AND ALL THE USES THAT WE NEED WITHIN THAT.

UM, IT'S COMPLETELY SURROUNDED BY RESIDENTIAL AND RESIDENTIALS BEING PROPOSED.

AND THE PROPOSED LAND USES IN ZONING DIMENSIONAL REQUIREMENTS THAT THE APPLICANT IS PROPOSING TONIGHT MEET THE

AND AGAIN, DUE TO THE UNIQUE NATURE OF THE AVIATION HEIGHT SUBDIVISION, A LOT OF THESE LOTS ARE ACTUALLY, UM, KIND OF ALREADY COMPLYING WITH THAT R SIX, UM, LOT WITHIN DEATH AND REQUIREMENTS.

SO THREE, WHETHER THE USE IS PERMITTED BY THE PROPOSED CHANGE WILL BE CONSISTENT AND APPROPRIATE WITH EXISTING USES IN THE MEDIA AREA.

AGAIN, IT'S THE AVIATION HEIGHTS SUBDIVISION.

UM, PROPERTIES WITHIN THE AVIATION HEIGHTS ARE ZONED R TWO AND THEY MAY ACTUALLY MEET THE DI.

THE DIMENSIONAL REQUIREMENTS OF OTHER ZONING DISTRICTS AND R SIX AND R TWO ARE BOTH INTENDED FOR DETACHED SINGLE FAMILY HOMES WITH THINGS LIKE SCHOOLS, CHURCHES, AND PARKS TO CREATE THAT BASIC NEIGHBORHOOD UNIT.

AND FOUR, UH, SHIRTS, FIRE EMS AND POLICE HAVE BEEN NOTIFIED OF THIS ZONE CHANGE AND HAVE NO OBJECTION.

AND A PUBLIC HEARING NOTICE WAS MAILED TO S-E-U-C-I-S-D AND WE HAVE NOT RECEIVED ANY ADDITIONAL CRITERIA FROM THE PLANNING AND ZONING COMMISSION OR CITY COUNCIL.

SO STAFF HAS BROUGHT FORWARD THESE AMENDMENTS TO HELP ALIGN THE UDC WITH RECENT CHANGES IN THE, UH, CITY CHARTER.

UH, THIS HAS TO DO WITH SPECIFICALLY, UM, SECTION 21 5 4.

THIS IS THE ZONING CHANGE SECTION IN THE UDC AND THE SUBSECTION THAT WE ARE PROPOSING AMENDMENTS TO IS, UH, E FOUR IN REGARDS TO THE PROTEST VOTE AND HOW WE COUNT IT.

UM, AND AS I MENTIONED, THIS IS A

DIRECT RESULT OF CITY CHARTER AMENDMENTS THAT WERE APPROVED ON NOVEMBER 5TH, 2024 BY SHIRTZ VOTERS.

AND IN THAT CHARTER AMENDMENT, BASICALLY THE ORDINANCES FOR ZONE CHANGES, UH, WENT FROM, UH, TWO HEARINGS TO ONE.

SO NOW WE ONLY HAVE ONE HEARING.

SO THE PREVIOUS CHARTER REQUIRED TWO, AND SO THAT REQUIRES SOME UPDATING IN SOME OF OUR LANGUAGE.

AND SO THIS IS THE EXISTING SECTION OF THE UDC WITH RED LINES.

UM, AS YOU CAN SEE, THAT HAS A FIRST READING AND THEN A SECOND READING SECTION WHERE WE DON'T REALLY NEED THE SECOND READING ANYMORE.

SO WE'VE MADE SOME EDITS HERE.

WE GOT RID OF THE SECOND READING PART AND WE GOT RID OF, UH, SUBSECTION C THAT YOU SEE THERE ABOUT HOW TO COUNT BETWEEN FIRST AND SECOND.

ALL, ALL OF IT'S JUST KIND OF, IT NO LONGER APPLIES ANYMORE.

SO WE'VE, UH, WE'VE BASICALLY WHITTLED THIS DOWN INTO A SMALLER SECTION HERE THAT BASICALLY SAYS, UH, WHICH WAS ALREADY THERE BEFORE.

BUT BASICALLY WHEN YOU, YOU KNOW, THE PROTEST VOTE HAS TO BE COUNTED ON THE RECEIVED ON THE FRIDAY BEFORE, UH, CONSIDERATION FROM CITY COUNCIL.

SO, UH, WHEN EVALUATING UDC AMENDMENT STAFF USES UDC SECTION 21 5 47 D UH, NUMBER ONE, THE PROPOSED AMENDMENTS, THE HEALTH SAFETY, GENERAL WELFARE OF THE CITY.

SO STAFF IS JUST TAKING STEPS TO ENSURE THE WELLBEING OF HIS RESIDENTS BY MAKING ITS DEVELOPMENT CODE MORE CLEAR AND EASY TO UNDERSTAND.

AND ALSO ALIGNING WITH CITY CHARTERS.

UH, NUMBER TWO, THE PROPOSED AMENDMENT IS CONSISTENT WITH THE GOALS, OBJECTION AND POLICIES OF THIS UDC.

SO THE CHANGE IN THE CHARTER INDICATES A NEW POLICY DIRECTION.

SO UPDATING THE UDC IS CREATING THAT CONSISTENCY.

UH, NUMBER THREE, THE PROPOSED AMENDMENT CORRECTS AN ERROR, MEETS THE CHALLENGE OF CHANGE CONDITIONS OR IN RESPONSE TO CHANGES IN STATE LAW.

THESE AMENDMENTS ARE A DIRECT RESPONSES TO THE CHARTER AMENDMENTS, AS I'VE, UH, ALREADY SAID, AND OTHER FACTORS WHICH ARE DEEMED RELEVANT AND IMPORTANT.

SO NO OTHER ADDITIONAL FACTORS HAVE BEEN DEEMED RELEVANT AT THIS TIME, BUT THIS PUBLIC HEARING DOES PROVIDE AN OPPORTUNITY TO INTRODUCE ANY ADDITIONAL CONSIDERATIONS.

UM, THAT SYSTEM IS UP AND RUNNING AND PROVIDING THE WASTEWATER TO THE NEW SEWER PLANT.

SO AFTER A COUPLE OF WEEKS OF, UH, HOPEFULLY SUCCESSFUL OPERATION, I GUESS, I DON'T KNOW IF THE CITY'S GONNA MAKE A, AN ANNOUNCEMENT THAT IT'S UP AND RUNNING.

AND I WOULD SAY FROM A PLANNING AND ZONING STANDPOINT, GET READY BECAUSE THE APPLICATIONS ARE GONNA START ROLLING IN, I THINK ONCE WORD GETS OUT THAT THAT WASTEWATER SYSTEM IS UP AND RUNNING.
